ELIGIBILITY: Sam’s Golden Ticket Giveaway is open only to residents of Arizona who reside within a 4.5-mile radius of Fly Bye located at 3912 East Camelback Road, Phoenix, AZ 85018 or Fly Bye located at 21001 North Tatum Boulevard, Phoenix, AZ 85050 and who are 18 years of age or older at the time of entry. Employees of Fox Restaurant Concepts LLC or its subsidiaries, as well as those employees’ immediately family (spouse, parents, siblings, children and household members) are not eligible.
SWEEPSTAKES PERIOD: Sam’s Golden Ticket Giveaway (the “Sweepstakes”) will be between 11:15 AM Mountain Standard Time on September 7, 2023 and 8:45 PM Mountain Standard Time on September 24, 2023. (“Sweepstakes Period”). The Sweepstakes computer, as determined by Sponsor in its sole discretion, is the official time keeping device for the Sweepstakes.

AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, all entrants fully and unconditionally agree to and accept these Official Rules and the Sponsor’s decisions which are final and binding in all matters related to the Sweepstakes. Winning the prize (described below) is contingent upon fulfilling all requirements set forth herein. HOW TO ENTER: There are two ways to enter the Sweepstakes.
With Purchase Place and pay for a delivery order with a minimum order of $30 (minimum amount is pretax, pre-delivery charge and does not include any discounts on food or beverages) on the Fly Bye Restaurant website during the Sweepstakes Period September 7 –24, 2023. You must add the menu item “Sam’s Golden Ticket” to your cart before checking out to qualify as an entry. By completing this transaction, you will automatically be entered into the Sweepstakes. Only orders placed directly through the Fly Bye website are eligible entries. Multiple entries are not allowed. Orders can be for deliveries on the same day or for a scheduled delivery during the Sweepstakes period.
Orders made through any third-party food delivery service (such as Door Dash, Ubereats or Grub Hub) are not eligible for the Sweepstakes.
Without Purchase You may enter the Sweepstakes without making a purchase by mailing a 3” by 5” note card on which you have hand-printed your name, address in the qualifying 4.5-mile radius, phone number with area code, email address, date of birth and the words “Sam’s Golden Ticket” to Fox Restaurant Concepts, LLC at 4455 E. Camelback Road, Suite B100, Phoenix, AZ 85018. MAIL ENTRIES MUST BE RECEIVED BY 5:00 PM MOUNTAIN STANDARD TIME ON SEPTEMBER 24th, 2023 TO QUALIFY. Limit one entry per outer envelope.
The entry and the applicant must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. You may enter only once no matter how many eligible orders you make or envelopes you mail. You may not enter more times than indicated by using multiple addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of the Sponsor. Sponsor is not responsible for lost, late, incomplete or misdirected entries, which will all be disqualified.
PRIZE AND THE VALUE OF THE PRIZE: There will be one Grand Prize Winner. The Grand Prize winner will receive: (a) a check in the amount of three thousand dollars ($3,000); (b) Fly Bye for one year in the form of a $1,200 Fly Bye gift card ($100 gift card distributed for each of the 12 calendar months), and. (c) Sam Fox personally delivering prizes to their house.
The value of the Grand Prize is $4,200. The specifics of the prizes shall be solely determined by the Sponsor. No prize substitution shall be permitted except at the Sponsor’s discretion. The prize is nontransferable. All federal, state, and/or local taxes owed on the prize shall be the sole responsibility of the winner.
Acceptance of prize constitutes permission for the Sponsor to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
TIMING OF DRAWINGS AND NOTIFICATION TO WINNER: On September 25, 2023 the Sponsor will select the winner in a random drawing consisting of all qualified entries from both Fly Bye locations made during the Sweepstakes Period. The winner will be considered a provisional winner until verification of eligibility by the Sponsor. The winner will be verified no later than October 1, 2023.
The verified winner will be contacted by the Sponsor and a delivery will be scheduled. Sam Fox, our founder, will personally deliver the winner’s prizes to the winner’s qualifying residential address noted on the Fly Bye order. If the winner is a mail-in applicant, the Sponsor will contact them for a delivery time (during Fly Bye opening hours) for the mail-in applicant.
The winner must be present at their order residence (or the qualifying residence address noted in the mail-in entry) when the prize is delivered. If the winner is not present during the scheduled delivery, the winner will be disqualified and a substitute provisional winner will be selected from among the remaining entrants. The winner must be willing to be videotaped when the delivery is made. The winner consents to being recorded by news crews and marketing teams for use by the Sponsor.
VERIFICATION OF ELIGIBILITY: The provisional winner is subject to verification of their eligibility and the completion of certain tax forms. The provisional winner will not be designated the winner and receive their prize until the verification process is completed. The verification process will include a declaration of eligibility and an IRS Form W-9. The provisional winner must return both to the Sponsor within ten days of the date the Sponsor emailed the forms to the provisional winner at the email address provided in the Fly Bye order or on the mail-in entry. If a provisional winner fails to return these materials timely, the provisional winner forfeits the prize.
A PARTICIPANT IS NOT A WINNER UNLESS AND UNTIL SPONSOR HAS COMPLETED ITS VERIFICATION OF PARTICIPANT’S ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES.
ODDS OF WINNING: Odds of winning will depend upon the number of eligible entries received.
DISPUTE RESOLUTION: By participating in the Sweepstakes, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Sponsor and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Arizona without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the prizes, shall be filed only in the state or federal courts located in Phoenix, Arizona and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. By participating in this Sweepstakes, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
EFFECT OF TECHNICAL INTERRUPTIONS: Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures, or any other reason, or incomplete, damaged, misdirected, illegible, stolen or lost entries. Sponsor reserves the right, in its sole discretion to disqualify any person tampering with the entry process, the operation of the web site or otherwise, in violation of the rules. Sponsor reserves the right to disqualify any non-conforming entries. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this promotion if not capable of completion as planned, including infection by computer virus, technical corruption, non-authorized human intervention or force majeure. In the event of cancellation, Sponsor reserves the right to select provisional winners from among all eligible entries received prior to date of cancellation.
PERMISSION TO USE IMAGE: Except where prohibited by law, entry constitutes permission to use winner’s name, voice, likeness, photograph, video and any statements regarding this Sweepstakes for editorial, public relations, promotional and advertising purposes on behalf of Sponsor without compensation.
WINNER ANNOUNCEMENT: Sponsor will post the name of the winner on its Instagram site, once the winner verification is complete. The news team will also announce the winner.
